STATE OF GEORGIA COUNTY of GLYNN NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain Deed to Secure Debt from TIMOTHY J. WILLIAMS to BANK OF AMERICA, N.A. dated September 15, 2006, filed for record September 22, 2006, and recorded in Deed Book 2052, Page 187, GLYNN County, Georgia Records, and as modified by that certain Loan Modification Agreement recorded in Deed Book 3138, Page 307, GLYNN County, Georgia Records, and as modified by that certain Loan Modification Agreement recorded in Deed Book 3326, Page 235, GLYNN County, Georgia Records. Said Deed to Secure Debt having been given to secure a Note dated September 15, 2006 in the original principal sum of ONE HUNDRED FORTY ONE THOUSAND THREE HUNDRED EIGHTY TWO AND 0/100 DOLLARS ($141,382.00), with interest from date at the rate stated in said Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at GLYNN County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in September, 2015, the following described property: ALL OF THAT CERTAIN LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE 1356TH G.M. DISTRICT, GLYNN COUNTY, GEORGIA, DESCRIBED AND IDENTIFIED ACCORDING TO THE MAP AND PLAN OF 'HIGHLAND PARK SUBDIVISION EXTENSION', DATED JULY 29, 1958, PREPARED BY ATWOOD M. FREEMAN, GEORGIA REGISTERED LAND SURVEYOR NO. 533, AND BEING RECORDED IN THE OFFICE OF THE CLERK OF SUPERIOR COURT, GLYNN COUNTY, GEORGIA IN PLAT DRAWER 7, MAP NUMBER 231, AS ALL OF LOT NUMBERED TWENTY-THREE (23), HIGHLAND PARK SUBDIVISION EXTENSION, GLYNN COUNTY, GEORGIA. REFERENCE IS HEREBY MADE TO AFORESAID PLAT AND TO THE RECORD THEREOF FOR THE PURPOSE OF MORE PARTICULARLY DESCRIBING AND IDENTIFYING THE LOCATION, METES AND BOUNDS OF THE SUBJECT PROPERTY AND FOR ALL OTHER PURPOSES ALLOWED BY LAW. To the best of the knowledge and belief of the undersigned, the party in possession of the property is TIMOTHY J. WILLIAMS and TOINISE LATRELLE WILLIAMS or a tenant or tenants. Said property may more commonly be known as: 194 PATRICK DRIVE, BRUNSWICK, GA 31523. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney's fees having been given).
